Terms of Service

The plain-language agreement for using GetClerk: what we do, what you're responsible for, and how billing works.

01What GetClerk is

GetClerk is a WhatsApp-based admin assistant for South African tradespeople, operated by Afrimont Enterprises ("we", "us"). You message GetClerk to capture receipts, keep track of jobs, draft quotes and invoices, manage your diary and send reminders to your customers. These terms are an agreement between you (the business owner who signs up, "you") and us.

By messaging GetClerk and completing sign-up, or by subscribing, you agree to these terms and to our Privacy Policy.

02Your account

• Your account is linked to the WhatsApp number you sign up with. Keep that phone secure: anyone who can message from it can act for your business.
• You may add team members. You choose their role, and you are responsible for what they do on your account.
• The details you give us (business name, VAT status and number, contact details) must be accurate. They appear on your quotes and invoices.

03Free trial and subscription

• New accounts start with a free trial. We'll tell you before it ends.
• After the trial, continued use needs a paid subscription. Prices are shown before you pay, are in South African rand, and are billed monthly in advance through our payment processor.
• You can cancel at any time. Your subscription runs to the end of the period you've paid for; we don't refund part-months.
• If a trial ends or a payment isn't made, your account becomes read-only for a grace period, then dormant. Your records are kept, not deleted, and you can come back by subscribing. See the Privacy Policy for how long we keep data.

04You stay in charge of your business

GetClerk uses AI to read receipts and understand your messages. It is good, but not perfect. That is why we ask you to confirm before anything important happens.

• Check before you confirm. You approve receipts, quotes, invoices, bookings and messages to customers before they are saved or sent. You are responsible for what you approve.
• Tax is yours. GetClerk helps you keep records, and it calculates VAT from the figures you confirm, but we are not tax practitioners or accountants. You remain responsible for your tax returns, VAT and dealings with SARS. Check with your accountant.
• Prices are yours. Quotes and invoices contain the prices, rates and mark-ups you set or approve. GetClerk does not set your prices.

05Messages to your customers

When you ask GetClerk to send something to one of your customers (a quote, an invoice, or an appointment reminder or change), it is sent on your behalf and on your instruction.

• Only give us customers' contact details that you are allowed to use to contact them about their work with you.
• Don't use GetClerk for marketing messages to people who haven't agreed to receive them, or for spam.
• WhatsApp and SMS have their own rules (for example, when a business may message someone). We apply those rules for you and may decline to send a message that would break them. If a customer opts out, we stop messaging them.

06Acceptable use

You agree not to use GetClerk to:

• break the law, or send anything fraudulent, abusive, defamatory or misleading;
• impersonate anyone, or send messages that aren't about your genuine business;
• interfere with the service, try to access other people's data, or reverse-engineer it;
• break WhatsApp's or Meta's terms and policies, which also apply when you use WhatsApp.

We may suspend or close an account that breaks these rules. Where we reasonably can, we'll tell you why first.

07Availability and changes to the service

We work to keep GetClerk running, but we rely on third parties (including WhatsApp, SMS providers, AI providers and hosting) and can't promise it will always be available or error-free. We may improve, change or remove features. If we make a change that materially reduces what you've paid for, we'll let you know and you may cancel.

08Liability

GetClerk is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits or lost business), or for losses caused by information you confirmed that turned out to be wrong.

To the extent the law allows, our total liability to you for any claim is limited to the subscription fees you paid us in the three months before the claim arose. Nothing in these terms limits any right you have under the Consumer Protection Act, 2008, or other law that cannot be excluded.

09Your data

Your records are yours. We use them only to run GetClerk for you, as described in our Privacy Policy. You can ask us to export or delete your data at any time. See Delete my data.

10Ending the agreement

You can stop using GetClerk and cancel your subscription at any time. We may end this agreement with 30 days' notice, or immediately if you seriously breach these terms. After it ends, our Privacy Policy governs what happens to your data.

11Changes to these terms

We may update these terms. If a change is significant, we'll tell you over WhatsApp before it takes effect. Continuing to use GetClerk after that means you accept the updated terms.

12Law and contact

These terms are governed by the law of the Republic of South Africa.
